AN ACT Relating to correction of double amendments relating to regulation of mobile and manufactured homes; reenacting and amending RCW 46.12.290; and reenacting RCW 46.04.302.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. RCW 46.04.302 and 1989 c 343 s 24 and 1989 c 337 s 1 are each reenacted to read as follows:
"Mobile home" or "manufactured home" means a structure, designed and constructed to be transportable in one or more sections, and is built on a permanent chassis, and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities that include plumbing, heating, and electrical systems contained therein. The structure must comply with the national mobile home construction and safety standards act of 1974 as adopted by chapter 43.22 RCW if applicable. Manufactured home does not include a modular home. A structure which met the definition of a "manufactured home" at the time of manufacture is still considered to meet this definition notwithstanding that it is no longer transportable.
Sec. 2. RCW 46.12.290 and 1989 c 337 s 4 and 1989 c 343 s 20 are each reenacted and amended to read as follows:
(1) The provisions of chapter 46.12 RCW
insofar as they are not inconsistent with the provisions of chapter 231, Laws
of 1971 ex. sess. or chapter 65.20 RCW apply to mobile or manufactured homes ((regulated
by chapter 231, Laws of 1971 ex. sess.)): PROVIDED, That RCW 46.12.080 and
46.12.250 through 46.12.270 shall not apply to mobile or manufactured
homes.
(2) In order to ((lawfully))
transfer ownership ((or add a secured party to)) of a mobile home,
all registered owners of record must sign the title certificate releasing
their ownership.
(3) The director of licensing shall have the power to adopt such rules as necessary to implement the provisions of this chapter relating to mobile homes.
