AN ACT Relating to extradition agents; amending RCW 10.34.030; providing an effective date; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. RCW 10.34.030 and 1967 c 91 s 2 are each amended to read as follows:
The governor may appoint agents (((1)))
to make a demand upon the executive authority of any state or territory for the
surrender of any fugitive from justice, or any other person charged with a
felony or any other crime in this state ((or (2) to accept the voluntary
surrender of any such person who has waived extradition)). Whenever an
application shall be made to the governor for the appointment of an agent he
may require the official submitting the same to provide whatever information is
necessary prior to approval of the application.
((The accounts of the agents appointed by
the governor under this section shall in all cases be paid from the state
treasury out of funds appropriated for that purpose upon claims approved by the
office of the governor. The office of the governor may prescribe the amounts
to be reimbursed to such agents, in the manner in which legislative bodies of
political subdivisions of the state may prescribe the amounts to be reimbursed
to officers and employees thereof, as set forth in RCW 42.24.090: PROVIDED,
That these expenses shall be reasonable, and shall be computed on the basis of
actual expenditures incurred, and not on an hourly or per diem basis.))
NEW SECTION. Sec. 2. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect July 1, 1993.
