AN ACT Relating to an exemption from Title 48 RCW; and adding a new section to chapter 48.01 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 48.01 RCW to read as follows:
This title does not apply to an organization, publication, or its subscribers, that:
(1) Is or is published by a nonprofit organization that is registered under chapter 19.09 RCW;
(2) Acts as an organizational clearing house for information between subscribers who have financial, physical, or medical needs and subscribers who choose to assist with those needs, matching subscribers with the present ability to pay with subscribers with a present financial or medical need;
(3) Pays for the subscriber financial or medical needs by payments directly from one subscriber to another;
(4) Suggests amounts to give that are voluntary among the subscribers, with no assumption of risk or promise to pay either among the subscribers or between the subscribers and the publication;
(5) Receives subscription fees or other payments or charges of any kind annually from subscribers that do not exceed an amount equal to 8.34 percent of the total suggested amounts to give published annually; and
(6) Discloses plainly in bold ink on the first page of any pamphlet, advertisement, questionnaire, or enrollment or subscription form:
"WARNING: THIS IS NOT AN INSURANCE CONTRACT. IF YOU ARE NOT HELPED WITH ANY OF YOUR NEEDS, YOU HAVE NO LEGAL RECOURSE AGAINST ANY OTHER SUBSCRIBER OR THE ORGANIZATION. NO CONTRACT OF INSURANCE OR INDEMNIFICATION EXISTS EITHER IN FACT OR IMPLIED."
