Exempting from the shoreline management act certain projects that have been granted hydraulic permits.

          AN ACT Relating to hydraulic permit exemptions from the shoreline management act; and adding a new section to chapter 90.58 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 90.58 RCW to read as follows:

          A public or private project that is primarily designed to improve fish habitat or fish passage, that has been approved by the department of fisheries after consultation with the department of wildlife, has been given a hydraulic permit, and local government determines that the project does not substantially affect other concerns of this chapter, is exempt from the permitting requirements of this chapter.  A letter of exemption must be obtained from the local government.
